Consumers Energy has locations throughout Michigan’s lower peninsula.  Our preference is for an attorney located within 30-60 miles of any Consumers Energy Service Center or willing to relocate (relocation package is available), or able to work out of our Washington, D.C. office.  However, we will consider candidates looking to work remotely in certain other approved locations. 


Candidates living in the following states are not eligible for remote work but are still eligible for the relocation package: Arkansas, California, Colorado, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Massachusetts, Mississippi, Missouri, New York and North Dakota.


We are looking for:  


We are seeking a highly motivated attorney for a dynamic legal role primarily supporting federal energy regulatory strategy, compliance, and related litigation.  Consumers Energy is Michigan’s largest energy provider, delivering electricity and/or natural gas to 6.7 million of the state’s 10 million residents in all 68 Lower Peninsula counties.  Through our innovative Clean Energy Plan, we are leading the clean energy transformation.  Successful candidates will demonstrate a commitment and ability to support the Company’s purpose – World Class Performance Delivering Hometown Service – by developing and applying litigation skills, regulatory expertise, and compliance judgment in a wide variety of matters while working collaboratively with employees across the organization.


The Federal Energy Regulatory Attorney will be a member of the Litigation, Environmental, and Federal Energy Regulatory Commission (FERC) practice group within the Consumers Energy Legal Department.  The Company is looking for an attorney with experience – and/or a demonstrated desire to develop expertise – in matters relating to the electric and natural gas energy industry and associated litigation.  This position will routinely involve research, analysis, and advice to clients on regulatory strategy and compliance issues.  It will also involve litigation at FERC and other tribunals, including state and federal courts at both the trial and appellate levels. In addition, this role will involve drafting and interpreting legal agreements and assisting with transactions.  This position is ideal for an attorney who desires to provide broad support to the commercial and strategic objectives of a large, leading-edge energy company, and who thrives with a significant amount of variety in day-to-day responsibilities.  Specific energy-related experience is not required to apply or to be seriously considered for this role.

In this role, you will:  


  • Develop and apply expertise in the legal and regulatory constructs, tariffs, rules, and stakeholder processes administered by FERC, the Midcontinent Independent System Operator (MISO), and the North American Electric Reliability Corporation (NERC). 
  • Provide legal support to a diverse range of business units within Consumers Energy Company, as well as other affiliates of CMS Energy Corporation. 
  • Provide timely, thorough, and accurate counsel and strategic advice to the Company on a variety of subjects, including the rules and requirements of energy regulatory bodies – primarily FERC, MISO, and NERC.
  • Monitor, develop comments on, and summarize the business and regulatory implications of new federal and state court decisions, regulatory developments, and general trends in the electric and natural gas industry.
  • Review and provide guidance on stakeholder proposals and positions within regulatory bodies such as MISO or FERC and assist in drafting the Company’s positions for presentation to and advocacy in stakeholder processes.
  • Apply and/or develop expertise in applicable energy tariffs and advise clients on their requirements.
  • Represent clients in potential investigatory and enforcement matters as needed.
  • Apply and continue to develop excellent legal research and writing skills.
  • Support general litigation matters as needed to advance and protect the Company’s interests, including in business disputes and energy matters.
  • Apply and continue to develop skills in drafting, negotiating, and interpreting a wide variety of agreements, contracts, and other complex legal documents.

  • Supervise and manage outside counsel in various matters, including drafting requests for proposals and preparing and monitoring compliance with legal budgets.
    Learn the Company’s business and serve as a both a legal and business advisor.
  • Work collaboratively with other attorneys and clients in a team-oriented environment while also demonstrating an ability to learn and work independently when needed.
  • Exercise exceptional legal and analytical skills, understand the importance of client objectives, and display excellent judgment in advising clients.
  • Be comfortable serving as a single point of contact who pulls in subject matter experts as necessary and allocates to staff at appropriate levels in the legal department.
  • Identify legal and business risks, and recommend concise, clear, and practical options to clients, while recognizing that risk-free solutions are infrequent.
  • Work effectively under pressure, show initiative and leadership, understand how to prioritize assignments, and embrace a fast-paced environment.
  • Communicate comfortably with Company management as well as employees across all levels and areas of the Company.
  • Maintain meticulous confidentiality commensurate with the sensitive nature of this work.
