This attorney position will primarily involve representing client interests in a variety of environmental-related legal, regulatory, and compliance matters. The attorney will advise clients on legal obligations, regulatory requirements and practical considerations under several different environmental statutory frameworks, including: the Natural Resources and Environmental Protection Act (NREPA); the Comprehensive Environmental Response Compensation, and Liability Act (CERCLA); the Resource Conservation and Recovery Act (RCRA); the Toxic Substances Control Act (TSCA); the Oil Pollution Act (OPA); the Emergency Planning and, the Community Right-to-Know Act (EPCRA); the Federal Water Pollution Control Act (commonly referred to as the Clean Water Act (CWA)).  Such work will involve handling litigation and managing outside counsel and consultants on environmental litigation, drafting and negotiating environmental terms on administrative orders, contracts, purchase and sale agreements, leases, easements, restrictive covenants and licenses, and responding to state and federal notices of violation.  This position will also advise clients on environmental associated risks related to asset purchases and sales, liability transfers, and decommissioning activities.

    • The complex interface of the law, regulatory structure, and technical engineering matters;

    • Formal proceedings or negotiations with sophisticated individuals, corporations, or government agencies.
  • Developing strong working partnerships with clients in a team-based environment and through clear communication.
  • Working independently and with little supervision.
  • Developing strong subject matter expertise that the client relies on for regular advice and counsel.   
  • Balancing legal risks with the clients’ goals and helping the clients develop business strategies to achieve those goals. 
  • Excellent writing skills.
  • Providing support to other practice groups in the legal department on matters outside of the environmental realm.
  • Managing multiple assignments and projects at the same time. 

 

Requirements:

 

  • A law degree and licensed to practice in Michigan
  • 3+ years’ experience in litigation and/or administrative hearings work experience as an attorney.

  • Experience addressing RCRA and CERCLA issues
  • Utility and/or other regulatory background
  • Experience working with U.S. EPA Region V and the Michigan Department of Environmental Quality

 

Overview

The Attorney Job Family is utilized solely in the Legal Department.  Performing all of the legal functions for the Company including but not limited to: thorough legal research on statutes or case law, ability to analyze facts as they pertain to a particular law and provide guidance to clients, communicate decisions in an understandable way.  After appropriate legal research, can support the legal conclusions and positions to a client, court or adversary.

 

Nature of Work

The essence of the work that is performed by the Attorney Job Family is a wide variety of legal functions, involving following generally accepted legal practices and using accepted legal theory.

 

At the lowest level in this job family, the work performed may tend to be of a routine nature that is reviewed by more senior members of the department.  The work responsibilities can be proficiently performed after a relatively short training period.

 

At the highest levels in this job family the work performed will tend to be of a complex nature involving knowledge of various functional/specialized disciplines where the work responsibilities can only be proficiently performed after a relatively long training / experience-related time period.  The work environment often includes dealing with risk and limiting exposure.

 

Leadership, management, facilitation and interaction with senior management will be markedly increased at the mid - highest levels of this job family while the need for direction and supervision will be markedly decreased.  While problem solving and analysis is required at all levels, recommendation and implementation for very complex matters becomes the norm at the highest levels and will often have a major bearing on the company’s business.  In addition, skills such as the ability to think on your feet, composure under fire and effective communication across all levels of the organization and with outside stakeholders become more finely honed at the higher levels. 

 

Essential Functions

 

Oversees the management and review of Company contracts and legal documents with specified departments.  Represents the Company in legal matters and gives legal advice.  Conducts research on statutes and case law pertaining to specific areas of expertise.  Analyzes the facts as they pertain to a particular law and gives guidance to clients.  Effectively communicates to facilitate and ensure adherence to Company policies and procedures.  Defines alternatives and balances risks and relays alternatives to the client.  Acts as a liaison to internal and external legal counsel.  Responsible for effectively advocating when presenting a legal position to a court or tribunal, including appellate courts.   Ensures the accuracy of legal opinions by conducting ongoing review of state and federal laws and regulations.  Reviews legal pronouncements issued by various regulatory bodies and recommends revisions to policies and procedures.  Maintains records of designated legal activities.  Analyzes, interprets, and verifies legal documents and reports; makes corrections and updates as necessary. Maintains regular and predictable attendance during regularly scheduled work hours at assigned worksite.  Supervisory positions will coordinate the activities of a designated unit; determine work procedures, prepare work schedules and determine methods for expediting work flow; assigns, reviews and approves the work of subordinate staff.  Regular attendance is expected.
